Napster, fighting for its life, has offered to pay the recording industry $1 billion to settle the ongoing copyright infringement suit that threatens to shut down the wildly popular site: $150 million per year for five years to the five major labels and $50 million to independent labels and artists.
Interim Chief Executive Hank Barry for the first time outlined plans for Napster's conversion to a pay service. Users would pay $3 to $10 a month depending on the number of downloads.
The Recording Industry Association of America, representing the labels in the lawsuit, would not comment on Napster's new offer.

The 9th U.S. Circuit Court of Appeals said Napster must prevent users from gaining access to copyrighted content through the lists of songs archived by its users. The appeals court ruling does not immediately shut down the file sharing service. It returns the case to Northern District Court Judge Marilyn Hall Patel, who in July ordered Napster to shut down pending a trial on copyright infringement. "We are very disappointed in this ruling by the three judge panel and will seek appellate review" said Napster interim CEO Hank Barry.
Napster can stay in business until U.S. District Judge Marilyn Hall Patel retools her injunction, which the appellate court called overly broad.
Napster is not shut down, but under this decision it could be.
